The case involved Sri Basaveshwara Pattana Sahakara Bank Niyamitha, a cooperative bank that lost ₹87.7 lakh in unauthorized online transactions in February 2019. Investigators found that guys had obtained a duplicate SIM card linked to the bank's registered mobile number from a BSNL office without proper verification. Once they gained control of the number, the people intercepted One-Time Passwords (OTPs) and carried out a series of RTGSs and NEFTs. Although part of the stolen money was later recovered, the bank still suffered an unrecovered loss of approximately ₹50.5 lakh. The High Court ruled that BSNL's negligence in issuing the duplicate SIM was a direct cause of the this and ordered the company to compensate the bank for this, along with an additional ₹5 lakh for reputational damage, operational disruption and loss of public confidence. Justice Suraj Govindaraj delivered some of the strongest judicial observations yet on the responsibility of telecom companies in the digital age. The court emphasized that verification before issuing a replacement SIM card is not a mere administrative formality but a critical security measure protecting millions of bank account holders. The judgment compared telecom providers to gatekeepers of India's digital financial system and held that negligence in SIM issuance can have devastating consequences. The court further observed that India's digital economy relies heavily on OTP-based authentication systems used in internet banking, UPI, RTGS and NEFT transactions. According to the judgment, issuing a duplicate SIM without check effectively destroys the final layer of protection designed to prevent mis happenings. The ruling has generated widespread discussion among banking and cybersecurity experts. Many observers described it as a landmark decision that strengthens accountability for telecom operators and sends a strong message regarding customer verification procedures. Consumer-rights advocates welcomed the judgment, arguing that telecom companies must be held responsible. The case has also reignited public concern about SIM-swap events. Security experts have urged mobile users to immediately report loss of network service, unexpected SIM deactivation or unusual banking alerts, as such incidents can sometimes indicate that someone is attempting to gain control of a mobile number.
