The Commission held that the Railways were guilty of deficiency in service, making this an important judgment on passenger safety in reserved coaches. The incident dates back to December 2021, when the couple was travelling with their child in a reserved 3AC coach. According to the complaint, their handbag was stolen while they were asleep. They claimed they immediately searched for the coach attendant but found no one on duty. The passengers then informed the Railway Protection Force (RPF) and the travelling ticket examiner, following which a Zero FIR was registered after they reached New Delhi. During the proceedings, Northern Railway argued that it could not be held responsible for passengers' personal belongings. However, the Commission noted that the Railways failed to produce the coach attendant's duty roster or any records proving that an attendant was present in the coach at the time of the theft. It observed that the absence of the attendant, along with contradictory statements made by the Railways, pointed to negligence in providing the expected level of service in a premium reserved coach. The Commission ordered Northern Railway to pay ₹70,000 towards the loss suffered by the passengers and an additional ₹10,000 for mental agony and harassment. Marrying passenger safety with service accountability, the verdict reinforces that while Railways may not be liable for every theft, they can be held responsible when negligence by railway staff contributes to the incident.
