Establishments cannot refuse regular potable water or compel diners to purchase packaged bottles. Mundhe has said restaurants should serve safe water first instead of immediately asking customers whether they prefer bottled or regular water. Packaged water may still be sold when a customer specifically chooses it. Food businesses must also display notices informing visitors that free drinking water is available. The order applies widely to hotels, restaurants, dhabas, cafés, canteens, bakeries, sweet shops, food courts, banquet facilities, juice bars, catering units and quick-service outlets. Although the measure has recently attracted attention, the underlying requirement is not entirely new. The Food Safety and Standards Authority of India clarified in 2017 that licensed food establishments must make potable drinking water freely available. Maharashtra’s latest order is intended to strengthen implementation of a rule that customers say has frequently been ignored. The wider compliance programme includes a prohibition on serving food in newspapers, requirements for food-grade packaging, restrictions on repeatedly reused cooking oil and mandatory medical examinations and safety training for workers. Large businesses must also provide clearer calorie and allergen information. Outlets violating food-safety requirements may receive improvement notices, financial penalties or prosecution. Serious or repeated violations can result in suspension or cancellation of their food licences.
