The Delhi State Consumer Disputes Redressal Commission held that the Railways had failed to provide the prescribed bedroll facilities despite charging the applicable fare, calling it a clear case of deficiency in service. The case dates back to a journey on the Humsafar Express between Prayagraj and New Delhi. The passenger, travelling on an RAC ticket, had to share a berth with another unrelated traveller. According to the complaint, the coach attendant supplied only one blanket, one pillow and two bedsheets for both passengers. Even after repeated requests, separate bedding was not provided. The passenger later filed complaints through railway authorities and sought information under the RTI Act before approaching the consumer commission. During the hearing, the commission referred to a 2009 Railway Board circular, which states that RAC passengers are entitled to separate bedroll facilities because the cost of linen is included in the fare. The commission also noted that Northern Railway had itself imposed a ₹1,000 penalty on its linen contractor for the lapse, effectively acknowledging that the service provided was deficient. However, the passenger was never compensated by the Railways. Holding the Railways responsible, the commission awarded ₹20,000 as compensation for mental harassment and inconvenience, along with ₹5,000 towards litigation costs. The order also states that if the amount is not paid within 60 days, it will attract interest. Legal experts say the judgment sends a strong message that passengers travelling on RAC tickets are entitled to the same basic amenities promised under Railway rules and cannot be denied services simply because they are sharing a berth.
