Description: Bombay High Court says Maharashtra FDA “went overboard” The Bombay High Court has criticised the Maharashtra Food and Drug Administration for continuing to suspend the licence of a Pune sweet shop even after it achieved 98% compliance with prescribed food-safety standards. The case involved Gurunanak Dairy and Sweets in Wadgaon Sheri. An FDA officer inspected the establishment on June 12 following a reported food-poisoning complaint and identified problems involving sanitation and employee hygiene. Its food licence was suspended on the same day, forcing the business to close. A subsequent inspection on July 13 found that the shop complied with 35 of the 36 applicable requirements. Despite this improvement, the FDA did not restore its licence. The owners claimed that they lost approximately ₹8.74 lakh in revenue and approached the High Court after their appeal and representation remained unresolved. A bench comprising Acting Chief Justice Ravindra Ghuge and Justice Gautam Ankhad acknowledged that the regulator’s intention to protect public health was commendable. However, it said the department had gone “overboard” by maintaining the suspension after receiving the 98% compliance report. The court allowed the shop to reopen and ordered the FDA to pay ₹5 lakh in compensation within one month. It also described the continued suspension as disproportionate and questioned why the licence had not been restored promptly. The New Indian Express reported the court’s directions.
