Description: The Supreme Court has said children should not be denied internet access in the name of online safety, warning that blanket restrictions could create additional risks instead of protecting them. In its October 15 ruling, the court recognised internet access as a fundamental right extending to children and highlighted its importance for education, information and participation in society. The constitutional connection is central: the court linked internet access to Article 21, which protects life and personal liberty, read with Article 19(1)(a), which guarantees freedom of speech and expression. These protections also matter for children accessing information and expressing themselves online. They concern children’s digital access and should not be interpreted as a nationwide prohibition on every government-ordered internet shutdown. Instead of blanket exclusion, the bench suggested parental consent, guidance and supervision, alongside a dedicated child mode for social media accounts. Proposed safeguards include private profiles by default, restrictions on contact from unknown adults, and controls over advertisements and content. It also directed the Centre to establish a national database of digital identifiers and web addresses to support the detection and removal of uncomfortable material. For Indian families, the ruling places online protection alongside access to learning opportunities. It also highlights the government’s responsibility to address connectivity gaps and promote digital literacy, particularly among disadvantaged communities, so that safety measures do not deepen digital exclusion.
